General terms and conditions

These are the general terms and conditions of AVS-Radiant Radiant Education (vof), having its registered office at (3471 GG) Kamerik on Van Teylingenweg 130 (KvK number 81838565). These general terms and conditions apply to the use of www.avs-radiant.nl and the resulting agreements. These general terms and conditions are valid from 1 May 2021.

Definitions

Provider: The natural person, legal entity or other provider offering Products to Users via the Platform.
Content: any information, data or files made available by the Provider via the Platform, including - but not limited to - company information, the Product Offer and Experiences.
User: any visitor to the Platform (both Consumer and business visitor) who may proceed on the Platform to (among other things) place an order, request information, ask a question, carry out a Registration or write a review.
Registration: the registration by a User for a Product via the Platform, by filling in the required fields and agreeing to the applicable general terms and conditions of AVS-Radiant Radiation Education.
Online continuing education: a remotely delivered online training course, taken via an internet connection and equipment provided by the participant.
Agreement: the agreement concluded between the Provider and a User on the basis of the User's Registration for a Product with the Provider via the Platform.
Platform: all underlying pages from www.avs-radiant.nl
Product: the product and/or service offered by the Provider, including - but not limited to - education, training and online continuing education related materials and information.

Registration and billing

The agreement between the Provider and the User comes into effect after the User, and if applicable, the employer, has paid the course payment and received the payment confirmation. The payment obligation indicated on the registration form by the User and the employer is the contracting party in the agreement with the Provider. Access to the online CVT courses remains valid for one year.

Grace period

You pay for an online continuing education course (e-learning) directly online, making it quick and easy to start learning at home. As a result, there is no cancellation or withdrawal right for e-learnings. Once purchased, you cannot cancel the training and get a refund. This is because the content has already been shown; you waive your right of cancellation upon confirmation of payment.

In the event of serious illness or calamity of the participant, you are authorised, with the consent of the Provider, to have the participant replaced by another person. You will then remain jointly and severally liable for the fulfilment of the agreement.

Confidentiality

Information provided by the User and/or its employer is treated confidentially by the Provider, its staff and/or persons working for it. See also the Privacy Statement. (link)

Intellectual property

The intellectual property rights relating to the Content are reserved by AVS-Radiant Radiation Education. Without AVS-Radiant Radiation Education's express written consent, the User is not entitled to disclose, exploit or, in any way, reproduce data from and/or portions and/or extracts of the Content provided or materials derived from materials developed by AVS-Radiant Radiation Education. No part of the Content may be reused, stored or transmitted to any other party.

AVS-Radiant Radiation Education reserves the right to make changes at any time to the course and information materials or the topics discussed during continuing education.

Liability

AVS-Radiant Radiation Education shall not be liable to the extent that the shortcoming as a result of which the User suffers damage cannot be attributed to AVS-Radiant Radiation Education (in any case including the content and implementation of the Product by the Provider) and/or the User has not given AVS-Radiant Radiation Education a reasonable period to remedy the shortcoming. A reasonable period shall in any case be 10 working days.

AVS-Radiant's liability is in any case limited to a maximum of the course fee paid by the User for the Product, or the course fee of that part of the Product from which AVS-Radiant Radiation Education's liability arises.

Complaints and disputes

Complaints about the delivery or content of a Product should be reported to AVS-Radiant Radiation Education in writing or by email. Complaints are always treated confidentially and a response will be given by AVS-Radiant Radiation Education within 14 days. Within 4 weeks of receiving the complaint, we will come up with a proposal for resolution. If due to circumstances it is not feasible to meet this deadline, we will indicate within the 4 weeks when you can expect a proposal from us.

The handling of a complaint is always done by e-mail. The complaint must be made known to AVS-Radiant Radiation Education within three months of its occurrence. Complaints reported to AVS-Radiant Radiation Education outside this period will not be considered. The complaint will be registered, the correspondence and the manner of settlement will be archived for 2 years. If no solution can be reached jointly, an independent third party will be called in. The mediator can be reached by e-mail (mediator.rvs@gmail.com). The mediator's decision is binding for AVS-Radiant. The costs associated with calling in a mediator will be borne jointly.

Dutch law applies exclusively to all legal relationships to which AVS-Radiant Radiation Education is a party. Only the court in Utrecht (currently Rechtbank Midden-Nederland, location Utrecht) is competent to take cognisance of any disputes after the parties have failed to mutually resolve the dispute, unless the law imperatively prescribes otherwise.
